Tent Rentals
ALL CHANGES, REWORK, ADJUSTMENTS AND DELAYS TO INSTALLATION DUE TO THE CLIENT AVAILABILITY, THE SITE READINESS, OR CLIENT CHANGES WILL BE BILLED AT $125/HOUR WITH A 1 HOUR MINIMUM.
CONTRACT – TERMS & CONDITIONS
RESERVING EQUIPMENT: All rental items are tailgate delivery (tailgate means within 50 feet, additional feet from tailgate are $0.50 per foot). Equipment will be reserved upon the DOWN PAYMENT of up to 50% of total charges, this DOWN PAYMENT is NON-REFUNDABLE. This equipment cannot be sub-rented or used by any other party other than that listed on the given invoice. Within five business days of the scheduled event, items cannot be cancelled. Cancelled items within these five days will be charged to the renter at full rental cost.
Deposits are non-refundable. Deposits are a downpayment for the service.
MISSING OR DAMAGED ITEMS: Universal Rentals and Events LLC will pick up the items on a specified date and at a time agreed upon at delivery. If all items are not present, items not returned to Universal Rentals and Events LLC within 2 business days after the event are considered missing. Missing or damaged/excessively dirty items will be charged to the client at replacement/cleaning cost. A detailed invoice on these items will be provided to the client.
FINAL PAYMENT: Final payment is due on delivery, and will be made by cash, check, MasterCard, Visa, or Discover OR AMEX.
ALL CREDIT CARD/ONLINE PAYMENTS ARE SUBJECT TO A 3.5% CREDIT CARD PROCESSING FEE.
DELIVERY & SET UP: Universal Rentals and Events LLC will strive to accommodate client delivery requests; however, delays and changes in the schedule are sometimes unavoidable. We try to communicate any scheduling changes as they occur. All items will be delivered and picked up at a designated location. The client must be available to count all items upon delivery and pickup; otherwise, Universal Rentals and Events LLC counts will be considered to be accurate. If any tent is ordered, the tent and liners for the tent will be properly set-up and secured in a designated area by the delivery personnel. All additional items will be placed under the tent to be set-up by the renter, unless otherwise requested. Table & chair setup fees are $0.50 per chair & $1.00 per table. There is no warranty that rented items are free of defects. The renter takes full responsibility of proper setup of tables and chairs to ensure proper leg locking in full stability. It is the responsibility of the renter to communicate to Universal Rentals and Events LLC of any underground wiring, pipes, sewage systems, or anything else that could interfere with the tent stakes. It is requested that the renter calls 811 to have their utility company come out and mark any underground lines prior to delivery of the rental items. Stakes are driven between 1-3 feet under the ground. If any underground systems are not communicated to Universal Rentals and Events LLC personnel or incorrect information is given, Universal Rentals and Events LLC will not be responsible for any underground damage.
CLEAN UP & PREPARATION FOR PICKUP: All floral arrangements, centerpieces, trash, and decorations of any kind should be removed from the tent(s) or other rental equipment before scheduled pickup time. There will be an additional charge for any items that have to be removed (per Universal Rentals and Events LLC personnel’s discretion). All chairs and tables should be stacked in the same designated location as delivered. If chairs/tables are not stacked a fee of $0.50 per chair and $1.00 per table will be charged to the renter. Linens should be food and particle free and shaken out before being placed in laundry bags. Linens that are returned with burns, wax, holes, tears, permanently stained, wet, or damp with mildew, or otherwise unusable will be charged to the client at replacement cost. A detailed invoice on these items will be provided to the client. Be sure to notify your caterer of these conditions. We do not offer party clean up services.
WEATHER: Tents are temporary structures designed to handle most normal weather conditions; however, there may be situations that become unsafe such as high winds or lightening. Evacuation of tents is recommended in these or other unsafe conditions. The renter is responsible for posting and maintaining in a public place on or near the tent an OSHA-compliant evacuation plan if needed. Universal Rentals and Events LLC will not be held responsible for any damages made to the rental items or by the rental items in the case of a severe weather emergency.
DAMAGE AND LIABILITY: The renter agrees that Universal Rentals and Events LLC holds no liability for any damage or injury caused by the use of rental items to the renter or any third party. The renter assumes all risk of personal property damage or personal injury and if any accident involving Universal Rentals and Events LLC items has occurred while it is in the renter’s possession, the renter shall make Universal Rentals and Events LLC aware by written statement of details of occurrence of the event including a police report and names and addresses of witnesses.
SUMMARY: RESPONSIBILITY OF THE EQUIPMENT REMAINS WITH THE CLIENT FROM THE TIME OF DELIVERY TO THE TIME OF PICKUP. Please be sure all equipment is secured when not in use and protected from weather. All collection fees, attorney fees, court costs, or any expense involved in the collections of rental charges or damaged items will be the clients’ responsibility. Be sure all equipment is returned according to these terms & conditions. The client is solely responsible for any additional charges incurred as a result of failure to meet these conditions.
I HAVE READ AND AGREE TO THE ABOVE TERMS & CONDITIONS AND ACKNOWLEDGE RECEIPT. THIS CONTRACT IS VALID FOR ALL RENTALS PURCHASED BY THIS CLIENT AND SUPERSEDES ALL PRIOR CONTRACTS.
Responsibility and Use & Disclaimer Warranties: You are responsible for the use of the rented
items. You assume all risks inherent to the operation and use of rented items, and agree to
assume the entire responsibility for the defense of, and to pay, indemnity and hold Universal Rentals and Events LLC harmless from and hereby release Universal Rentals and Events LLC from, all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Universal Rentals and Events LLC negligence, from the defective condition of the items, or any other cause. YOU AGREE THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.
Equipment Failure: You agree to immediately discontinue the use of rented items should it at
any time become unsafe or in a state of disrepair, and will immediately (one hour or less) notify
Universal Rentals and Events LLC of the facts. Universal Rentals and Events LLC agrees at our discretion to make the items operable in a reasonable time, or provide a like items if available, or make a like item available at another time, or adjust rental charges, The provision does not relieve renter from obligations of contract. In all events Universal Rentals and Events LLC shall not be responsible for injury or damage resulting in failure or defect of rented item.
Use of Equipment: Renter agrees & covenants to be satisfied with the instruction and condition
of equipment rented and the proper and safe use equipment, or that renter is so familiar and
conveyed to Universal Rentals and Events LLC you were. Renter further agrees that the items will only be used at the address listed on contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instruction manuals, operating instructions, and warnings related to rented items
Equipment Responsibility: Renter is responsible for equipment from time of possession to time
of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen,
damaged, renter will assume cost of replace or repair, including labor costs. Renter shall pay
a reasonable cleaning charge for rented items returned dirty.
Time of Return: Renter's right of possession terminates upon the expiration of rental period set
forth on the contract. Time is of the essence in this contract. Any extension must be agreed
upon in writing.
Late Returns: Renter shall return rented items to Universal Rentals and Events LLC during regular business hours, promptly upon. or prior to expiration of rental period. If renter does not timely return, the rental rate shall continue until items are returned.
Payment: Renter shall pay all charges payable on this contract in advance, provided however
that all forgoing shall not limit the amount of payable by renter hereunder and all additional
amounts hereunder shall be paid immediately as such costs are incurred. Renter shall pay all
reasonable costs of collections, court, and attorney fees. If rental charges are not paid within
(10) days of the due date, Universal Rentals and Events LLC at our discretion may re-calculate rental charges on a daily basis. Renter shall pay in addition to any other amounts payable hereunder, a service charge 2% COMPOUNDING per month on all past due accounts.
Additional charges: In addition to other charges and cost provided herein, renter shall pay
charges in accordance with company rates then in effect for the following services. Delivery
and/or Pick up to any location other than level ground. Set up of tables and chairs. Delivery and
Pickup after business hours, Saturdays, Sundays, and Holidays. Packaging materials not
returned. Service calls. Site survey and preparation.
Delivery & Pickup: Renter shall clean and repackage (in original packaging) the rented items
and if Universal Rentals and Events LLC agrees to pick up the item, renter shall make it available to Universal Rentals and Events LLC for pick up at a mutually agreed and convenient accessible location. Delivery and pickup shall be at the convenience of, and at the time designated by Universal Rentals and Events LLC. Renter agrees to pay a service charge for each extra delivery or pickup call required by Universal Rentals and Events LLC. Renter shall make its personnel available at the time designed for pickup, to assist, and pickup of all items.
Care of Equipment: In addition to its other obligations hereunder, Renter shall: Pay a reasonable
cleaning charge for items returned dirty. Protect the rented items from weather damage,
breakage, unauthorized or improper use, theft or loss while in possession of renter.
Insurance: Renter shall maintain, at renter's expense, liability, property and casualty insurance
coverage in amount sufficient to fully protect Universal Rentals and Events LLC and its equipment against any and all claims, loss, or damage. In the event of loss or damage, you shall exercise and shall empower us to exercise all your rights to obtain recovery under insurance and shall cooperate with Universal Rentals and Events LLC to obtain recovery. All insurance proceeds should be given or assigned to Universal Rentals and Events LLC
Site Preparation: Renter agrees to have site cleaned and ready for delivery and installation or
dismantled for pickup or the equipment, and also agrees to pay any additional charges for any
delay incurred along with any labor charges resulting in renter's failure to do so.
Permits & Licenses: Renter agrees prior to any installation of rental equipment including tents,
to obtain at renters expense, any and all necessary permits and licenses and other consents.
Subsurface Conditions: Renter agrees to obtain any locating of underground utilities before
delivery of rented items. Renter also agrees to reimburse Universal Rentals and Events LLC for any additional costs incurred as a result of undisclosed or subsurface conditions. Above All Party
Rentals is NOT responsible for any damage to underground sprinkler systems during tent and/or
inflatable installations. It is the customer's responsibility to provide Universal Rentals and Events LLC with a sprinkler line layout to decrease the risk of damage to a sprinkler line. However, even with a line layout there are no guarantees.
Hold Harmless Agreement: Renter agrees all risk and agrees to hold Universal Rentals and Events LLC and any of its staff harmless from and against any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly at or relating to; The delivery, loading, unloading, erection, installation, dismantling, and use of rented equipment. Contact of underground utilities, pipes, or any condition on renter's property. All necessary surface repairs.
Any injury or damage during the use of rented equipment including inflatables, dunk tanks, and
any interactive games.
Damage Waiver: If you agree to the damage waiver charge as specified, subject to the
limitations and exclusions below, Universal Rentals and Events LLC agrees to modify the terms of this contract and relieve you of liability for accidental damage to the rented item(s) on this contract, and for loss due to fire, collision, windstorm, upset, riot. We exclude from this waiver, however, any loss or damage due to theft, misuse or abuse, by conversion, intentional damage,
mysterious disappearance or other loss due to your failure to care for the rented item(s).
Returned Checks: There will be a $35.00 charge on any returned check for any reason.
